FOND DU LAC, WI (WTAQ-WLUK) – Prosecutors dropped charges filed after police found fentanyl pills hidden under the headlight of a vehicle – but could refile them in the future.
Devontay Bostick, 32, had faced four counts, including possession with intent to delivery fentanyl after a Jan. 27, 2024, traffic stop.
However, according to an order filed Tuesday, the state is waiting for more evidence in the case.
The State is respectfully requests dismissal of this case without prejudice. The reason for this request is that the State has additional discovery that has been disclosed by the law enforcement agency and the State is also awaiting other discovery from the agency as well. This evidence is necessary to prove the elements of this case beyond a reasonable doubt. To allow time to disclose that discovery to defense, the State is requesting that this case be dismissed without prejudice.
According to a release from the sheriff’s department, K9 Rip alerted on the vehicle during an open-air sniff and a search was conducted.
The deputy noticed a small black box with a cord attached to it tucked under the front passenger-side headlight. The box had two magnets glued to the back of it, allowing it to cling to metal in the engine compartment. Inside the box was a large quantity of “M-30” suspected fentanyl pills.
Bostick is currently in New Lisbon Correctional Institution on unrelated charges.
