OSHKOSH, WI (WTAQ-WLUK) — A woman was convicted Monday of a traffic citation for refusing to take an intoxication test after what appears to be a fatal drunk driving crash on New Year’s Day, where the victim was struck and killed by his pickup truck.
Shanelle Hofacre, 29, was issued the citation after the Jan. 1 crash on Knott Road in Winnebago County which killed Brandon Dodd, 24. Her driver’s license was suspended for one year, court records show.
Charges have not been filed in connection with the crash or fatality. The case remains under review. In court Monday, a prosecutor said there is an “underlying homicidal review” which continues.
The crash happened about 4 a.m. on New Year’s Day in the town of Omro.
A vehicle driven by Hofacre struck a pedestrian “near or on the roadway. The pedestrian was located deceased after being called in by a passerby. Operator of Unit 1 was located passed out due to alcohol consumption just up the road in a pole building with the keys to Unit 1 in her front jacket pocket. Operator of Unit 1 declined to provide her version of what happened,” the report states.
The roads were dry at the time, the reports states.
Although Hofacre was cited for refusing to take an intoxication test, a blood sample was obtained. Results are not cited in the report.
Dodd is listed as the owner of the vehicle which struck him.
Court records in the traffic citation case make reference to an OWI charge still pending, but no such charges or citations have been filed.
