GREEN BAY (WLUK) – The author known as “Uncle Fester” waived a preliminary hearing Friday on a new drug possession charge – and he disputed that the material seized was illegal.
Steven Preisler, 66, gained renown for his books on how to make ricin, methamphetamine and other drugs. Last year, he was charged with multiple drug manufacturing and delivery counts.
Preisler was arrested Aug. 9 after police witnessed a suspected drug deal in an east-side parking lot. Preisler left the scene in a vehicle. A short time later, he was stopped. Although no drugs were found on Preisler, the officer noticed small jar with a substance inside on the seat, which would have been under Preisler’s body. The material was butane hash oil, which tested positive for THC – the active ingredient in marijuana, according to the criminal complaint.
During the court appearance Friday, Preisler disputed the type of material seized.
“If you would see it’s a legal purchase at Holy Smokes head shop,” Preisler said.
Court Commissioner Cynthia Vopal didn’t address his claim.
An arraignment is scheduled for Sept. 12 on the new drug charge, and two bail jumping counts.
Preisler has also disputed the allegations from the original case, saying the substances were not the illegal materials as prosecutors allege. A Sept. 5 status conference is scheduled in that case.
Preisler also faces a civil suit filed by the city of Green Bay, seeking to have his Baird Street home declared a public nuisance in order to be sold or razed.
