GREEN BAY, WI (WTAQ-WLUK) – Stephen Preisler – the drug author known as “Uncle Fester” who now faces drug manufacture and delivery charges – calls the city of Green Bay’s civil lawsuit seeking to seize his house as a “comedy of errors” in a new filing with the court.
Preisler originally faced eight counts: four of manufacture or delivery of amphetamine, and one count each of possession with intent to deliver cocaine, possession of drug paraphernalia, possess methamphetamine precursors, and maintaining a drug trafficking house. After he posted bond, he was arrested again and charged with three more counts. In the criminal case, he does not have an attorney, and returns to court Oct. 26.
Separate from the criminal proceedings, Green Bay filed a civil lawsuit, seeking to have his home on South Baird Street declared a public nuisance. The city wants to force a sale or have the home demolished.
In a hand-written reply filed Monday afternoon, Preisler says the lawsuit “is so filled with errors as to be a comedy of errors, if it was not so serious.”
As he has done in court, Preisler repeats his claims that items seized from the home that prosecutors claim are drugs are not. For example, material he is charged with possessing as crack cocaine is actually potassium carbonate. He notes items were sent to the crime lab for testing.
“I urge you to put this filing on hold until theses results come in and further urge you to give a push to the Crime Lab to come back with a few results pertaining to this, so this filing can meet its just end,” Preisler wrote.
He also challenges the reasons why the city claims it is nuisance property. For example, some of the police calls to the home were because he was helping homeless people and giving them a place to stay, but then incidents happened, which weren’t drug related. Preisler asks for a detailed account of the police calls to the house.
A judge has issued a temporary restraining order closing the building.
No hearings have been scheduled in the case.
