GREEN BAY, WI (WTAQ-WLUK) — The city of Neenah will voluntarily stop enforcement of its sign ordinance while a federal court decides whether the ordinance is legal.
The proposed sale of the former Shattuck Middle School into residential apartments and other living spaces has been opposed by some neighbors. Yard sign opposing the redevelopment reading “Don’t Rezone Shattuck Middle School Leave R1 Alone” have been posted by some people. The city issued notices, demanding the signs be removed by Feb. 8. Timothy and Megan Florek, with the help of the Wisconsin Institute for Law and Liberty, filed suit in federal court, seeking to have the ordinance overturned.
During a telephone scheduling conference Thursday, Neenah’s attorney, Kyle Moore, said he advised the city to voluntarily stop enforcement of the ordnance.
That move was acceptable to the plaintiffs.
Judge William Griesbach said he had been inclined to grant a temporary restraining order against the city, but the voluntarily action made such an order unnecessary.
The two sides will submit written briefs next month, with Judge Griesbach then planning to issue a written ruling. At this point, no hearings or arguments in court are planned.
