GREEN BAY, WI (WTAQ-WLUK) – The suspect in a double-fatal crash has entered a not guilty plea to a traffic ticket issued in the case, but no decision has been made on if criminal charges will be filed.
Marcus Walker allegedly ran a stop sign Oct. 23 in New Denmark, killing Jamie Lee Cain, 42, and Katherine Mae Rathie-Dunn, 41.
The Brown County Sheriff’s Department issued Walker a citation for first offense operating while intoxicated, and requested criminal charges in the case.
At Walker’s initial appearance in November, however, Brown County District Attorney David Lasee said blood tests showed Walkers’ BAC was below the legal limit. Lasee asked for additional time to review if other charges, such as negligent homicide, should be filed.
Walker’s attorney, Brittany Van Rite, noted at the first court hearing that a preliminary breath test showed a BAC of just .036, well below the legal limit of. 08.
Walker had an initial appearance scheduled Wednesday on the OWI-1st ticket but he did not appear, as a written not guilty plea was entered ahead of the hearing. The next court date is a pre-trial conference set for Feb. 17.
Meanwhile, Lasee told FOX 11 Wednesday the case is still under review for possible criminal charges.
“We have not finalized a decision and we are still waiting for some additional information that would be relevant to that decision,” Lasee said.
At a previous court hearing, Domina Stamas, Rathie-Dunn’s sister, told the court she was pleased with the decision then not to file charges for the “tragic accident,” noting charges would not bring back her sister and her fiancé.
