OSHKOSH, WI (WTAQ-WLUK) – A court commissioner denied Andrew Clark’s request Wednesday to represent himself in a double murder case. Clark was subsequently ordered to stand trial.
Clark faces two counts of first-degree intentional homicide for the deaths of his wife, Melissa Clark, and another man, Lavar Wallace, at an Omro home on Oct. 21.
Before a scheduled preliminary hearing Wednesday, Clark questioned the authority of the court to have jurisdiction, and requested to represent himself. Court Commissioner Bryan Keberlein ruled Clark is not competent to represent himself.
The preliminary hearing then was held, with Clark’s attorneys continuing to represent him. After testimony from an investigator, Clark was ordered to stand trial.
Arraignment is scheduled for Jan. 19.
Clark is not the only person charged in the case.
Michael Draine is charged with one count of aiding a felon for allegedly helping Andrew Clark. Prosecutors say he was at the home that night, and allegedly helped Clark try to cover up the murders. He returns to court Jan. 19 for an arraignment.
The four went to a night club and returned to the Clark’s home. Draine heard the Clarks arguing in another room, then a gunshot. When he entered that room, Melissa Clark had been shot and Andrew Clark was holding the gun. Clark allegedly later shot and killed Wallace, according to the criminal complaint.
