GREEN BAY, WI (WTAQ-WLUK) – The motorist charged in connection with fatal drunk driving crash Sunday said he was driving because he was the “most sober,” according to the criminal complaint filed Monday.
Terral Wallace, 27, faces one count of homicide by intoxicated use a vehicle, and three counts of injury by intoxicated use a vehicle. A court appearance was scheduled for Monday afternoon.
According to the complaint, when police arrived at the crash on I-41 near Scheuring Road, Wallace said he recently purchased the vehicle and would “act up” at times.
“As Wallace approached (the officer), I could also smell a strong odor of intoxicants coming from his breath and clothing. Wallace’s eyes were red and he continuously repeated “I don’t want that girl to be dead,” the complaint states. “(The officer) asked Wallace when his last drink was and he informed his last drink was “about four hours ago” and said he only drank two beers. Wallace stated they were all at a party in Appleton and had all been drinking and he was driving them home because he was the most sober.”
Wallace later said “he had two beers and some Hennessey,” according to the complaint.
A witness told police the vehicle rolled at least seven times.
A field sobriety test was not performed because of Wallace’s injuries. A blood sample was taken at the hospital but no test results were cited in the complaint. There is no mention of a preliminary breath test.
The victims, including the woman killed, are only identified by their initials in the complaint. The Hobart-Lawrence Police Department has not identified her.
As for the others in the car: One is at a Green Bay hospital with a broken back and may be paralyzed, and two were taken to a Milwaukee hospital with one in a coma and the other’s condition unknown.
Four traffic citations were also issued Monday, including for operating a vehicle without a license, and failure to keep a vehicle under control, court records show
The white substance on Wallace’s face in the mug shot is paint that was in the vehicle, the complaint states.
