OSHKOSH, WI (WTAQ-WLUK) — The suspect in a shooting Saturday night in Oshkosh fired shots after being punched in the face — but shot someone else in the confusion, according to the criminal complaint filed Wednesday.
Devon Price, 23, was charged with four counts, including first-degree reckless endangering safety, for the incident. He’s expected to make an initial court appearance this afternoon.
According to the complaint, Price went to Oshkosh from his Omro home for a pub crawl. About 7 p.m., a group of people gathered near John and McKinley avenues.
“One of the videos shows a large group of people pushing and shoving each other in this area. You can see one black male attempt to break things up between Devon Price and another group of black males. A large black male wearing a black sweatshirt and beanie punched Devon Price in the face. Price then pulled out a handgun and shot someone else; not the person who punched Price,” the complaint states.
Price said he had been drinking, and someone was insulting him.
“He stated that someone grabbed his sweatshirt and punched him in his right eye. Price stated that everything ‘went black’ and he does not recall pulling his firearm or shooting. He stated that he was scared and felt he was going to be jumped by multiple people. He described that his brother had been jumped in the past and sustained injuries that impacted his mental capacity. Det. Wilkens showed Price one of the videos of the shooting. Price maintained that he could not recall due to his mental state going ‘black’ after being struck,” the complaint states. “He stated that he did not know the identity of the person who punched him; he also stated he did not know the identity of the person he shot.”
The victim “estimated that he was about five feet from the shooter at the time he was shot, but denied that he was the individual trying to break up the fight” and “confirmed he was not involved with the group that was fighting with the suspect,” the complaint states.
The victim was shot in the ankle.
The gun was found in a storm sewer.
