GREEN BAY, WI (WTAQ-WLUK) – Green Bay says it “acted within its lawful discretion in administering the public bidding process and evaluating bids,” and asked for a lawsuit filed by Miron Construction challenging the awarding of a bid for work on the Leicht Park pavilion to another company to be dismissed.
Green Bay awarded the construction bid to 8Pine Construction. Miron sued, arguing 8Pine failed to meet the bid requirements.
8Pine responded previously, denying claims it’s bid was “unresponsive and inaccurate.”
In its response, filed Monday, Green Bay also denied any errors or wrong doing, and asked for the case to be dismissed.
“The City substantially complied with all applicable statutes, ordinances, and bidding requirements,” wrote attorney Jonathan Smies. “The City lawfully exercised its right to waive informalities or non-material irregularities in bids.”
A Jan. 23 motions hearing is scheduled.
