GREEN BAY, WI (WTAQ-WLUK) – Omar Hernandez wants to withdraw his plea in connection with a murder stemming from a February 2023 bar fight.
Hernandez, 26, previously pleaded no contest to first-degree reckless homicide for the death of Edgar Rodriguez-Hernandez.
While Monday’s hearing was planned as a sentencing, Hernandez’s attorney was unavailable. As the parties were discussing scheduling, Hernandez said he wanted to withdraw his plea.
As a result, a new sentencing date of April 21 was set, but the possible plea withdrawal could be discussed instead.
Jose Hernandez, Omar’s brother, was previously sentenced to three years in prison for the case.
Both originally faced intentional homicide charges, but those counts were reduced as part of the plea deal.
According to the criminal complaints, police responded to Clayton Place, near Eisenhower Park, for report of shots fired on Feb. 11, 2023. One man, lying in a front yard, was dead with “massive trauma to his head,” while another was taken to the hospital with three gunshot wounds to the chest.
The incident was the continuation of a fight which happened at a bar a few hours earlier.
