GREEN BAY, WI (WTAQ-WLUK) — If the U.S. Supreme Court would overturn Roe v. Wade, it could make nearly all abortions illegal in Wisconsin.
The state has an 1849 law, which makes abortion a crime unless a woman’s life is in danger.
Roe v. Wade makes this unenforceable unless the Supreme Court’s draft opinion becomes a reality.
Pro-life organization, Wisconsin Family Action president, Julaine Appling says she was shocked to hear of the opinion leak.
“You recover from the shock and say alright this is just the first draft, it was dated Feburary 10th. There’s been a long time since February 10th, so I ultimately landed on cautious optimism with a wait and see approach because this is not the official final opinion issued by the court to the public,” said Appling.
If Roe were overturned, Appling says it would give individual states the right to have a discussion about abortion laws.
“To make the decision where we can all have input, where courts are deciding it, and we have the opportunity to debate on the merits and make a decision much much closer to where we actually live. Rather than turning it over to a court to have some kind of order or opinion,” said Appling.
But the 19th-century abortion ban has Wiscosnin pro-choice organizations sounding the alarm.
Planned Parenthood Advocates of Wiscosnin are urging people to call legislators to repeal Wisconsin’s criminal abortion law.
The Democratic Party of Wisconsin released a statement saying the stakes of the 2022 elections are even higher after this news saying,
We’re fighting for the ability of each person to make their own decisions about their body, life, and future. This is why we must re-elect Governor [Tony] Evers and Attorney General Josh Kaul and candidates… who will always do the right thing when it comes to reproductive health.
But state laws won’t change anytime soon, the state legislature isn’t in session until January 2023.
