GREEN BAY, WI (WTAQ-WLUK) – No charges are being filed at this time in connection with a double-fatal traffic crash, although the incident remains under investigation.
Marcus Walker allegedly ran a stop sign Oct. 23 in New Denmark, killing Jamie Lee Cain, 42, and Katherine Mae Rathie-Dunn, 41. Walker was booked into the jail on suspicion of drunk driving, but at his first court appearance, prosecutors asked for more time to review the case and get crime lab results.
At Wednesday’s hearing, Brown County District Attorney David Lasee said the blood tests showed Walker’s BAC was below the legal limit. While the case is still under investigation to determine if other charges – such as negligent homicide – should be filed, at this time there’s not sufficient evidence to charge Walker.
Walker’s attorney, Brittany Van Rite, noted at the first court hearing that a preliminary breath test showed a BAC of just .036, well below the legal limit of. 08.
Domina Stamas, Rathie-Dunn’s sister, told the court Wednesday she was pleased with the decision not to file charges for the “tragic accident,” noting charges would not bring back her sister and her fiancé.
Before the crash, Walker was already facing several misdemeanor charges on unrelated matters. His bond on that case was modified Wednesday to include an absolute sobriety provision, and a no contact order for the families involved in the crash.
The $50,000 cash bond which had been set in connection with the crash was canceled.
Court records show Walker was also issued a citation by the Brown County Sheriff’s Department for first-offense operating while intoxicated in connection with the crash. A not guilty plea was entered, and a Jan. 12 court date was set. It remains to be seen if that ticket will be dismissed.
