GREEN BAY, WI (WTAQ-WLUK) – For the second time, there’s been a change in the judge handling a lawsuit challenging the De Pere school district’s COVID-19 quarantine policy – meaning Monday’s hearing for the case has been canceled.
Stephanie McManus, a substitute teacher and parent of two high school students, sued the district, claiming the district didn’t have the authority to enact the policy it did. The district has not responded to the suit.
The first judge assigned to the case removed herself from it, citing a broad concern about the appearance she could not act impartially.
A second judge was assigned to the case, who scheduled a hearing for Monday on McManus’ request for a temporary restraining order prohibiting the district from carrying out its policy while the case was litigated.
However, the school district filed a substitution request on Thursday, which was granted Friday morning. No specific reason was cited in the motion, nor is one required.
The case is now assigned to Judge Marc Hammer. While Monday’s hearing will not happen, a new hearing date could be set as soon as today, according to a court official.
