GREEN BAY, WI (WTAQ-WLUK) – The City of Green Bay has asked a federal court to dismiss a lawsuit filed in the wake of George Floyd protests.
Gerardo Rodriguez and Manali Olesky sued the city, claiming their Constitutional rights were violated when then city enacted and enforced curfews, and that the curfews were illegally selectively enforced based on race.
In its most recent court ruling, the city offers arguments for each of the plaintiff’s claims, and why they should be rejected. It asks for “summary judgment,” which is a ruling before trial in its favor dismissing the case.
The plaintiffs have not responded to the city’s motion. No trial date has been set.
