APPLETON, WI (WTAQ-WLUK) — Competency issues have been raised again in the case against Alexander Kraus, whose insanity plea was rejected by a jury last week.
Kraus, 19, is, as of now, heading to prison. He had pleaded guilty to two counts of first-degree intentional homicide for shooting Dennis and Letha Kraus on April 14, 2019, at their Grand Chute home. A jury determined while Kraus suffered from a mental disease or defect, he could still had the capacity to appreciate his actions were wrong and could have conformed to the law. He faces two automatic life sentences at an Aug. 16 sentencing hearing, with Judge Mitchell Metropulos determining if Kraus will be eligible for parole and, if so, when.
In a motion filed late Thursday, attorney Greg Petit requested another psychiatric evaluation.
“As grounds, it is asserted that the defendant is currently unable to assist counsel in preparing for sentencing; the defendant has shown a remarkable decline since the completion of the Jury Trial,” Petit wrote.
Prosecutors have not yet replied to the motion. No hearings have been scheduled.
