GREEN BAY, WI (WTAQ-WLUK) – A judge Monday rejected a request to dismiss charges against a man who allegedly fired shots into a crowd during the looting of a downtown convenience store.
Leo Austin, 28, has pleaded not guilty to first-degree recklessly endangering safety and other counts for the May 31 incident. No trial date has been set.
The defense asked for the two felony counts to be dismissed, but Judge Thomas Walsh denied the request, court records show.
What started out as peaceful protests over the death of George Floyd during the day turned destructive. Officers were called to the Marathon Gas Station on Walnut Street for reports of shots fired from a vehicle, according to the criminal complaint.
Also during the incident, a crowd of people looted the gas station and damaged squad vehicles, including one with a K-9 officer inside. Other businesses in downtown Green Bay were damaged as well.
