GREEN BAY, WI (WTAQ-WLUK) — Two people who participated in protests in Green Bay back in June are suing the city, arguing the curfew placed at that time was unfairly enforced.
Gerardo Rodrigues of Allouez and Manali Oleksy of Green Bay allege that police targeted them based on race and because they were participating in the protests when they were arrested for curfew violations between June 1st and 6th.
Those curfews were put into place following several nights of rioting over the death of George Floyd in Minneapolis.
The lawsuit alleges the curfew was unconstitutional because it targeted only protesters, and not others who were out in downtown Green Bay in the evening. Additionally, Rodriguez, who is Hispanic, and Oleksy, who is of Indigenous descent, claim police targeted them for arrest because of their race.
The lawsuit asks a judge to allow others who were arrested to join as a class action. It also asks that Rodriguez and Oleksy’s prosecutions be ended.
The attorney who filed the suit, David Hassel of Green Bay, in September asked for curfew citations to be dismissed.
As of Wednesday afternoon, the city had not been served with the lawsuit and had not responded.
