APPLETON, WI (WTAQ) – A man who admitted to drinking and driving while three kids were in the vehicle entered a not guilty plea to the charges against him from a June 24 accident.
39-year-old Gustavus Dalton Jr. is facing two counts of injury by intoxicated use a vehicle. Police say Dalton told them that he drove through an intersection and his truck was hit by another vehicle, causing him to lose control.
Police say he admitted to consuming two “tall boy” cans of Hurricane before picking up his girls and later admitted to consuming the beverages while driving with the kids in the rear seat. He told police that he was aware that he broke a law but felt he was okay to drive.
A four-year-old and a six-year-old were injured. The girls were not in booster seats according to police. A 3-year-old who was in a car seat suffered minor injuries.
The driver of the other vehicle informed police that Dalton had a stop sign that he ignored.
