WAUKESHA, WI (WTAQ) – Anissa Weier’s attorney now says an adult homicide charge should be dropped, because his client was coerced by Slender Man.
Joseph Smith Jr. filed a brief in Waukesha County, urging the dismissal of the charge against the 13-year-old Weier. She and 12-year-old Morgan Geyser are accused of stabbing classmate Payton Leutner 19 times last May.
They allegedly said they did it in allegiance to the fictional Slender Man.
Smith said the attempted homicide charge is not valid, because his client believed that a character she perceived as real had threatened her and her family. By dropping the adult charges, Smith says the state could proceed in charging the two girls in juvenile court — something both defendants are pushing for.
The judge in the case plans to announce March 13th whether the girls should be ordered to stand trial on their adult charges.
Prosecutors said there’s clear evidence that support the adult charges.
