GREEN BAY, WI (WTAQ-WLUK) – The attorney for Ray Roddan, a chiropractor accused of inappropriately touching patients, entered not guilty pleas for him Thursday.
Roddan, 76, faces three misdemeanor counts of fourth-degree sexual assault for incidents dating back to 2021 with separate patients.
Roddan did not appear in court Thursday, as he is hospitalized due a medical condition, his attorney, Nicole Morley said. He returns to court Nov. 12.
Assistant District Attorney Claire Lamal requested that Roddan not be allowed to practice as a condition of bond. Morley opposed the request. Commissioner Chad Resar denied the request, noting Roddan is presumed innocent and needs the ability to earn a living.
Morley also objected to the criminal complaint, noting while there are just three charges, the information includes details about other potential victims whose situations are not charged. She asked for the “surplusage” to be stricken.
“These uncharged allegations, I believe, are improper character evidence,” Morley said.
Lamal defended the information, saying there is strength in numbers when accounting for allegations that happen behind closed doors. It also puts the defense on notice there could be evidence of other acts in the case.
Commissioner Resar agreed there are allegations outside the statute of limitations, but a determination of admissibility would be made later. He denied the motion to strike the information from the case.
According to the criminal complaint, the victims described how Roddan touched them sexually during treatments.
Roddan told investigators he attempts to get patients to agree to certain contact before an exam, but that system is “not foolproof,” the complaint states.
“Dr. Roddan stated, “I never do anything intentionally, is it inadvertent, potentially”. Investigator Lovato asked Dr. Roddan to give an example of inadvertent. Dr. Roddan stated, “I am not fondling”,” the complaint states.
