APPLETON, WI (WTAQ-WLUK) – Tyrese Simmons pleaded not guilty Wednesday to six charges for allegedly firing multiple shots in Appleton’s Erb Park. No one was injured in the June 25 incident.
Simmons also waived his preliminary hearing on the charges, which include second-degree recklessly endangering safety. He returns to court Sept. 23 for a pre-trial conference.
Simmons is scheduled to be sentenced that day on unrelated criminal damage to property and disorderly conduct charges. He also has pending charges in Calumet County for allegedly being a felon in possession of a firearm.
According to the criminal complaint, Simmons approached a bunch of juveniles, asking about a phone which had been lost or stolen. Simmons then allegedly pulled a gun out of backpack and fired. Witnesses reported hearing three or four shots.
Police found two spent 9mm casings and one unspent round near the park pavilion. Simmons was tracked down and arrested. Police found a gun in his backpack.
