GREEN BAY, WI (WTAQ) – Charges will not be filed against an Ashwaubenon Public Safety officer who shot and killed an armed robbery suspect last September.
Dustin Kuik of Two Rivers was shot on September 9, 2015, in the parking lot of a Lambeau Field-area hotel after officers say Kuik refused orders to drop his weapon and started to enter the hotel.
Kuik was wanted as a suspect in the armed robbery of a Mishicot convenience store a few days earlier.
Based on a complete review of the case, Brown County District Attorney David Lasee says Officer Brian Murphy acted lawfully to use deadly force.
Prosecutors say Kuik’s girlfriend, Raeana Nagy and her two children, were with Kuik when he was killed. Neither Nagy nor her children were hurt, as they were inside the vehicle Kuik exited.
Nagy is facing conspiracy charges for the robbery, because investigators say she was working at the store when Kuik robbed it.
Murphy had been with the Ashwaubenon Public Safety since June 2015. He was placed on administrative leave after the investigation. Ashwaubenon Public Safety Chief Eric Dunning said Wednesday that Murphy will be returning to active duty as early as next week.
