GREEN BAY, WI (WTAQ) – A Green Bay man is facing several charges following his arrest in an alleged domestic violence incident.
24-year-old Duwane M. Smith, Jr. is charged with strangulation and suffocation, battery and disorderly conduct. All three counts have domestic abuse enhancers.
According to the criminal complaint, Green Bay police got a medical call for a woman having trouble breathing related to asthma on Friday afternoon, December 11, 2015.
A fire department member notified an officer that the victim claimed she had been choked. The officer confirmed with the victim that she was attacked by Smith.
Smith and the victim have a child together, according to the complaint, and they are living together in the 900 block of S. Oakland Avenue.
Around 1 p.m. that day, the victim told police she awoke to Smith arguing with her, calling her a “Whore”, and yelling at her because she wanted to visit her mom while he watched the child.
Then, Smith grabbed her by the throat with his left hand and pushed her into a blue bin. She was seated in the bin, while Smith applied pressure on her throat as he stood over her. Struggling to breathe, she eventually was able to pull his hand away from her throat.
Smith continued yelling at her, calling her a, “Dumb bitch and a whore.” She argued back, but Smith then slapped her with his left hand across her face. The officer was told that Smith is right-handed and if, “He does things with his left hand it’s not as bad because it is his weak hand.”
The complaint states that Smith left the home and walked to a gas station. He returned to the home to find the victim packing to leave. She fled the home as Smith continued to scream at her. She went to a friend’s house, where she called the cops because of her trouble breathing.
Duwane Smith is due back in court March 9 for his preliminary hearing. If convicted on all charges, Smith faces more than 6 years in prison.
