SHAWANO, WI (WTAQ-WLUK) – Embattled campground owner Ann Retzlaff is facing is another legal battle, this one for control of her business.
Retzlaff faces a series of criminal charges related to a traffic stop last year and her arrest in April after a warrant was issued for her arrest for skipping court on the first case. On Tuesday, she was ordered to stand trial, with an arraignment date to be set.
Meanwhile, a separate, civil case has been filed by Bank First regarding the Gresham campground’s ownership. It is not listed as a foreclosure, however.
Bank First said it has issued two loans to the campground, for $942,019.37 and $586,997.17. Its motion to the court asked for a receiver to be appointed due to missed payments for the loan, insurance, and taxes.
“Upon information and belief, Debtor is insolvent as it has clearly demonstrated an inability to make timely payments of its obligations to creditors, including (among other things) its indebtedness to Petitioner,” the bank stated. “Given Retzlaff’s incarceration and conduct in court proceedings Petitioner has substantial concerns about the operation of the campground, the bar and restaurant at the campground, and the potential dissipation of collateral during Retzlaff’s incarceration and her reported and repeated confrontation with police and government officials.”
In her reply earlier this month, Retzlaff said the business was not insolvent, nor in danger of that, noting she was expecting full occupancy for Memorial Day weekend. She opposed the appointment of a receiver.
“The campground has continued to operate without my physical presence and will continue to operate as normal, as it has for the past twelve years,” she wrote.
However, last week a receiver was appointed to manage the campground’s finances. Another hearing is set for June 13, at which time a list of assets and liabilities may be reviewed, according to court records.
In another letter filed with the court Tuesday, Retzlaff objected to all charges against her, but did not specifically address any financial issues.
