MANITOWOC, WI (Wisconsin Radio Network) – The latest appeal for convicted killer Steven Avery is being denied.
Avery’s attorneys argued that information the state failed to turn over entitled Avery to a new trial for the 2005 murder of Teresa Halbach.
Avery’s attorney alleged the prosecution withheld a CD seized from a computer hard drive. Katherine Zellner said that hurt Avery’s defense and warrants a new trial.
Sheboygan County Judge Angela Sutkiewicz denied the motion Friday.
She says the information the prosecution failed to turn over was not the key information the defense argued was critical in this case.
Judge Sutkiewicz said in her decision that Avery’s computer hard drive included “violent pornography.”
