APPLETON, WI (WTAQ-WLUK) – A Nov. 9 trial planned in connection with a Kaukauna murder was postponed indefinitely Friday due to a change in defense attorney.
Dontae Payne and Tanya Stammer are charged with first-degree intentional homicide and armed robbery for the death of Brian Porsche at a home on W. Division Street on March 30.
Payne’s trial was scheduled to start next month. His attorney, Russell Jones, filed a motion in August, asking to be removed from the case, as he and Payne were not getting along. However, because that branch recently changed judges – Judge Yadira Rein was appointed to the post this summer by Gov. Evers – the hearing didn’t happen until Friday.
The judge granted Jones’ request to be removed. A new attorney will be appointed. A status conference is set for Oct. 25.
Stammer returns to court Dec. 7 for a status conference. No trial has been set for her, either.
According to the criminal complaint, Payne and Stammer targeted Porsche, with Payne allegedly shooting Porsche. The two then tried to make the scene look like a robbery, and tossed his phone & keys into Lake Winnebago.
