GREEN BAY, WI (WTAQ) — Brown County Clerk Patrick Moynihan will not abide by the subpoena to turn over election materials submitted by State Representative Janel Brandtjen of the Assembly Elections Committee.
In a letter drafted by County Corporation Counsel David Hemery, he says that the county maintains the subpoena is invalid and unenforceable because it doesn’t have the signatures required from Assembly Speaker Robin Vos and the Assembly Clerk.
The letter continues that Hemery hasn’t received contact as to how the county would pay to comply with the subpoena, which he says would amount to “significant unbudgeted costs”.
Brandtjen, as part of her committee’s investigation into the 2020 election, asked for the county to turn over ballots, voting machines, and other election materials.
