APPLETON, WI (WTAQ) — Appleton Police say a shooting on the city’s east side that left one man dead occurred during a break-in, and appears to be a legitimate case of self-defense.
Around 4:30 a.m., Appleton officers were called to the 2800 block of East Newberry Street, for a report of a suspicious person.
During the response, another 911 caller says a man broke into a neighboring house. The caller told officers they were in their bedroom with the door locked.
Appleton Police Captain Mike Frisch tells WTAQ that the suspect managed to break into the bedroom. That’s when the home owner apparently opened fire.
“I can tell you right now that’s what it looks like,” Frisch said, referring to a defensive shooting. “We’re waiting for more information from our investigators.”
Officers arrived, and said they found the man, identified as 38-year-old Jonathan James Tolley of Appleton, with a gunshot wound. He was taken to a local hospital, where he later died.
Investigators say they would like to speak with anyone who might have seen or had contact with Tolley between the hours of 2:00 A.M. and 4:30 A.M. on June 20th.
No residents in the home were injured.
