TWO RIVERS, WI (WTAQ-WLUK) — A local police officer has been cleared of wrongdoing in a November officer-involved shooting.
Investigators say that Two Rivers Police Officer Dakota Gamez was justified in shooting 31-year-old Nash Fiske during a November 4th traffic stop. Fiske, who was a passenger in the stopped vehicle, had grabbed a 9mm handgun before being shot.
Manitowoc County officials say Gamez won’t be charged.
Fiske’s mother, Bernadette Fiske Vanidestine, says she plans to appeal the ruling, arguing that her son had a medical condition that compounded the incident.
“The officer says there is something wrong with my son, so he’s seen the signs,” said Fiske Vanidestine. “My son suffered a head trauma and the flashing lights were sending him into seizure. If they would have waited a few more minutes, his body would have started convulsing from the seizure.”
The firearm was recovered and during a search of the vehicle, agents recovered a Ruger 9 mm handgun in the center console and ammunition in the trunk along with a large quantity of marijuana. According to the medical examiner’s report, Fiske suffered six gunshot wounds. He also had significant levels of methamphetamine and amphetamine in his blood stream.
