GREEN BAY, WI (WTAQ-WLUK) – A man who allegedly killed two of his relatives is competent to stand trial, a judge ruled Friday.
Oscar Lemus-Franco, 29, faces two counts of first-degree intentional homicide for the Sept. 28 incident at a residence on Clement Street. Gerson Alvarez-Franco and Jaime Lemus, both relatives of Lemus-Franco, were shot and killed.
The competency issue relates to Lemus-Franco’s ability to understand the proceedings and assist in his own defense. It does not address his psychiatric condition at time of the offense; that issue could be raised at a later stage of the case.
With the competency ruling, a preliminary hearing is the next step in the process. A balance of initial appearance was set for Dec. 29 for scheduling the preliminary hearing.
Lemus-Franco’s sister told police he “has been acting strangely for about a year and that he speaks to god who tells him to kill people,” the complaint states.
Lemus-Franco also faces charges for allegedly stabbing a police officer in the face following his arrest. He remains in custody on a $1 million cash bond.
