GREEN BAY, WI (WTAQ) — Two voices familiar to Northeast Wisconsin’s airwaves were in Brown County Court Friday morning.
Former 95.9 KISS FM morning show host Otis Day, whose legal name is Richard Dey, is facing a restraining order filed by Natalie Jansen of 101 WIXX’s morning show for alleged stalking and harassment. Also facing charges in the case is Emily Chagnon of Marion, who allegedly created an anonymous Facebook page called “Tiw’s Day Hollaback XXIW” to post about WIXX and it’s personalities.
The plaintiff alleges several posts targeted Jansen, and that Day contributed to Chagnon’s alleged misconduct on the page by sharing content to post and encouraging her behavior.
During the last court hearing in April, Day admitted he lied to investigators early in the investigation about his connection to Chagnon. For three hours on Friday, Day faced several meticulous questions from Jansen’s lawyer, Mark McGinnis.
“You’re going to notice that Mr. Day isn’t being honest as he is on the witness stand,” said McGinnis. “My purpose is to see if he’s going to be honest with us today.”
Day denies personally harassing anyone, though on Friday he expressed that he should have told Chagnon to stop her online activity.
“What’s the reason you didn’t?” asked McGinnis.
“Because I’m a wimp,” Day replied.
In examining evidence in the case, McGinnis asked about several online conversations between Day and Chagnon.
“It was communicated to you that Emily is trying to ‘get into Natalie’s mind’ correct?” asked McGinnis.
“Yes,” Day replied.
McGinnis then referenced an alleged comment made by Chagnon saying she wanted to “break” Jansen, which Day says he did not discourage.
The case returns to court on July 17, it is scheduled to last the whole day. So far, Day and Sgt. Richard Loppnow, the investigator in the case, have taken the witness stand. Loppnow appeared at the last court date and is expected to return on July 17.
A temporary restraining order was granted for Jansen against both Day and and Chagnon when the case was filed in late March. However, Day is set to work at Celebrate De Pere this weekend. The Judge in the case said Day can work at the event even if Jansen is in attendance.
