GREEN BAY, WI (WTAQ-WLUK) — Floyd Simmons is not competent to stand trial for allegedly trying to kill his girlfriend, a judge ruled Friday.
Simmons, 63, faces six charges, including attempted first-degree intentional homicide and strangulation and suffocation, for the Sept. 5, 2025, incident at Jackson Square Park in downtown Green Bay.
Competency refers to the defendant’s ability to understand court proceedings and assist in his own defense. After testimony from a doctor Friday, Judge Samantha Wagner ruled Simmons is not competent currently, but is likely to regain competency. He was committed for additional treatment and returns to court June 29 for another review.
Prosecutors say the victim, a 57-year-old woman, told officers she and Simmons got into an argument about her paying rent, as she was planning to move into his apartment. The victim said Simmons choked her. She was able to fight him off and ran to a nearby hotel to call for help.
Police eventually found Simmons. As officers were taking him in for questioning, the criminal complaint says he muttered, “should’ve killed that (expletive), should’ve stomped on her neck.”
Police say Simmons also made threats and used racial slurs against officers and made sexual comments toward staff members at the Brown County Jail after he was arrested. The criminal complaint also says police found a crack pipe on Simmons.
