Gov. Evers Takes Action on Dozens of Bills

• Creates a property tax exemption for certain prefabricated recreational structures located in licensed campgrounds; 
• Clarifies that those structures are not subject to a municipal permit fee; and 
• Expands the existing personal property tax repeal aid program to compensate local taxing jurisdictions for the resulting revenue loss.

Senate Bill 529, now 2025 Wisconsin Act 118: 

• Repeals obsolete tax provisions and tax credits that have already been sunset by other provisions, such as an ethanol and biodiesel fuel pump credit, a manufacturing sales tax credit, and income tax rates and brackets for tax years prior to 2025; and 
• The bill provides much-needed clarity for Wisconsin taxpayers about which credits they are allowed to claim and the requirements they need to follow.

Assembly Bill 459, now 2025 Wisconsin Act 119: 

• Creates an exception to county public works notice and competitive bidding requirements for public work undertaken for the purpose of providing housing for persons placed on supervised release under ch. 980, Wis. Stats.; and 
• The bill provides counties with additional flexibility to address housing needs associated with supervised release placements while potentially reducing costs for counties and local taxpayers.

Assembly Bill 737, now 2025 Wisconsin Act 120: 

• Creates an additional mechanism for municipalities to finance residential infrastructure through special assessments approved upon petition of all taxable property owners within a proposed neighborhood improvement district; and  
• Makes targeted modifications to certain existing neighborhood improvement district requirements.

Senate Bill 78, now 2025 Wisconsin Act 121: 

• Modifies requirements for the distribution and labelling of fertilizer and soil or plant additives that are produced from converting manure into compost, ultimately promoting the creation and use of composted manure-based fertilizers by reducing the testing and labeling requirements for such product; 
• Allows a person to distribute a fertilizer that is produced from converting manure into compost or vermicompost and their derivatives, and that has a combined weight of nitrogen, phosphorus, and potassium that is less than 24 percent of the total weight of the fertilizer; 
• Exempts a fertilizer that is produced from converting manure into compost from being required to contain a minimum amount of certain plant nutrients; and 
• Provides that the Wisconsin Department of Agriculture, Trade and Consumer Protection (DATCP) may not require a controlled experimental field test to substantiate the efficacy and usefulness of a soil or plant additive produced from converting manure into compost.

Senate Bill 593, now 2025 Wisconsin Act 122: 

• Makes technical modifications to various insurance statutes generally administered by the Wisconsin Office of the Commissioner of Insurance; 
• Clarifies whether individual navigators or navigator entities must submit to state and federal background checks, including training, examinations, and other requirements, and defines individual navigators and navigator entities separately; and 
• Replaces the generic term of navigator throughout statute to clarify which requirements apply to individual navigators or navigator entities, or both.

Assembly Bill 668, now 2025 Wisconsin Act 123: 

• Expands the mental health providers who may perform an examination to determine whether or not the individual is competent to refuse medication or treatment; and
• Allows qualified psychiatric advanced practice registered nurses, in addition to physicians, to conduct mental health competency evaluations to help address backlogs in those competency evaluations, thus reducing delays in court proceedings and protecting patient rights.

Senate Bill 748, now 2025 Wisconsin Act 124: 

• Eliminates the requirement that purchasers provide a sales tax exemption certificate to claim the existing sales and use tax exemption for the sale of precious metal bullion.

Senate Bill 448, now 2025 Wisconsin Act 125: 

• Provides additional flexibility in the use of videoconferencing technology in court proceedings by creating an exception to a general rule that an objection to the use of videoconferencing technology will be sustained in certain civil matters.

Assembly Bill 223, now 2025 Wisconsin Act 126: 

• Modifies requirements for circulating nomination and recall papers such that a person must be an eligible voter in Wisconsin to circulate papers for any office except president and vice president.

Assembly Bill 924, now 2025 Wisconsin Act 127: 

• This is a technical correction bill that would correct and clarify current law relating to various subjects; and
• Among other technical corrections, the notable statutory revisions under the bill include: 
  • Adding clarifying language regarding the certification of protective services maintenance of effort requirements; 
  • Removing obsolete references to tax incremental finance district exceptions for districts that have expired and which had provisions repealed by 2023 Wisconsin Act 138; 
  • Correcting a reference to the agency in charge of suspending or denying licenses for non-attorneys in worker’s compensation cases to the Division of Hearings and Appeals in the Department of Administration instead of the Department of Workforce Development (DWD), consistent with the intent of 2021 Wisconsin Act 232; and 
  • Making modifications intended in 2023 Wisconsin Act 27 to change the term “epinephrine auto injector or prefilled syringe” to “epinephrine delivery system.”

Assembly Bill 925, now 2025 Wisconsin Act 128: 

• This is a technical correction bill that would reconcile conflicts in certain statutes and administrative rules; and 
• The Legislative Reference Bureau and state agencies review current state statutes to look for errors, omissions, or conflicts, and biennially, the Law Revision Committee reviews these errors and recommends remedial legislation.

Assembly Bill 926, now 2025 Wisconsin Act 129: 

• This is a technical correction bill that: 
  • Removes obsolete cross-references due to vetoes or repeals; 
  • Corrects cross-references; 
  • Inserts missing words or creates consistent language due to partial vetoes or to parallel other existing statutory definitions or language; 
  • Addresses treatment of sections of enacted bills that impact the same statutory sections; 
  • Corrects style inconsistencies. 
• The Legislative Reference Bureau and state agencies review current state statutes to look for errors and omissions, and biennially, the Law Revision Committee reviews these errors and recommends remedial legislation.

Assembly Bill 927, now 2025 Wisconsin Act 130: 

• Amends certain statute sections to ensure accuracy in numbering and cross references; 
• Makes technical corrections to reflect a number of acts; and 
• The affected chapters are primarily related to tax and medical licensing statutes, and changes to these chapters were enacted as part of the 2021 and 2023 legislative sessions.

Assembly Bill 928, now 2025 Wisconsin Act 131: 

• Removes requirements related to registrants of livestock submitting information adhering to federal standards that are no longer in effect.

Assembly Bill 929, now 2025 Wisconsin Act 132: 

• Clarifies that only active Wisconsin Retirement System (WRS) employees are permitted to make additional contributions to a WRS account; 
• Modifies current law to permit new employees aged 70 or up to participate in the income continuation program; and 
• Deletes obsolete statutory references that require the Department of Employee Trust Funds to maintain accounts for Social Security remittances and hold the department liable for delinquent Social Security payments from participating WRS employers.

Assembly Bill 930, now 2025 Wisconsin Act 133: 

• Corrects a statutory cross-reference related to the existing enforcement authority of the Division of Banking within the Wisconsin Department of Financial Institutions for earned wage access service providers.

Assembly Bill 931, now 2025 Wisconsin Act 134: 

• Makes technical corrections to certain Wisconsin Department of Health Services (DHS) statutes; 
• Amends current law to reflect the name change of HealthNet of Janesville to HealthNet of Rock County Inc.; 
• Changes “general” to “generalized” in reference to generalized public health nursing programs under current law; and 
• Replaces “advanced practice nurse prescribers” with “advanced practice registered nurses” for purposes of supervising a school district or local health department immunization program and being agents of the department for the provision of services without compensation for programs and services provided by a local health department or serving as a supervisor of an immunization program.

Assembly Bill 932, now 2025 Wisconsin Act 135: 

• Replaces the reference to the system of “uniform crime reports” for the purposes of the Wisconsin Department of Justice’s data collection duties with a reference to the “National Incident-Based Reporting System”; 
• Modifies a cross-reference to the crime of stalking that is included in the definition of “violent crime” for the purposes of the school zone penalty enhancer; and  
• Removes a cross-reference to the crime of stalking as a misdemeanor offense and would add the crime of stalking to the list of felony offenses to which the penalty enhancer applies.

Assembly Bill 933, now 2025 Wisconsin Act 136: 

• Removes cross-references that no longer exist in Wisconsin Department of Public Instruction administrative rules due to 2018 modifications and removes a grandfather provision that applied to individuals who taught industrial arts 90 years ago.

Assembly Bill 934, now 2025 Wisconsin Act 137: 

• Removes obsolete or duplicative language from state law and updates certain definitions and statutory references administered by the Wisconsin Department of Revenue.

Assembly Bill 935, now 2025 Wisconsin Act 138: 

• Makes a variety of minor changes to update and clarify the Wisconsin Department of Veterans Affairs’ statutes, including updates to terminology and grammatical changes to statutory provisions;  
• Repeals two expired grant programs;  
• Clarifies that the department, in providing information to service members and veterans on the availability of post-traumatic stress disorder services, may provide information on and referrals to either medical services or mental health services;  
• Changes the procedure that the Board of Veterans Affairs must follow with respect to reporting on rules proposed by the department;  
• Makes a clarifying change to the statute regarding information that the department may compile about deceased veterans’ graves; and 
• Updates outdated references to federal law concerning disabled veterans.

Assembly Bill 936, now 2025 Wisconsin Act 139: 

• Makes technical and remedial changes to statutes administered by DWD by updating outdated references to federal law; 
• Replaces repealed or obsolete federal statutory citations with current references, including updates related to vocational rehabilitation, workforce development programs, migrant labor contractor registration, worker’s compensation, and federal motor vehicle safety standards; and 
• The bill is intended to maintain consistency between state and federal law and does not create new programs or substantive policy changes.

Assembly Bill 938, now 2025 Wisconsin Act 140: 

• Reconciles cross-references in the statute that permit a court to enter a judgment of divorce or legal separation based on an affidavit, which was created in 2025 Wisconsin Act 40.

Assembly Bill 939, now 2025 Wisconsin Act 141: 

• Updates statutes to remove obsolete provisions related to the state public defender’s term and procedure for removal.

Assembly Bill 940, now 2025 Wisconsin Act 142: 

• Repeals two obsolete provisions requiring the Wisconsin Economic Development Corporation board of directors to hire an electronics manufacturing small business development director and an economic development liaison project position by Dec. 31, 2022.

Assembly Bill 446, now 2025 Wisconsin Act 143: 

• Relates to antisemitism and evaluating evidence of discriminatory intent for any law, ordinance, or policy in this state that prohibits discrimination based on race, religion, color, or national origin.
