GREEN BAY, WI (WTAQ-WLUK) — A construction company is asking a judge to lift a temporary order prohibiting it from being awarded a bid on work at a Green Bay park.
8Pine maintains it followed all requirements in bidding for work on a new pavilion at Leicht Park, disputing claims made by Miron Construction in a lawsuit.
In its response filed this week, 8Pine writes:
The Court should not substitute its judgment for that of the City and force an award to Miron. Doing so would not serve the public interest, as Miron claims, and in fact would harm it. Miron cannot demonstrate a likelihood of success on the merits or any of the other elements required to support the extraordinary relief it seeks.
8Pine also alleges:
This case is not about protecting taxpayers; it is about a losing bidder attempting to use the courts to either exact revenge against a former employee-turned-competitor, or to secure through litigation what Miron could not get through the ordinary bid process.
The city also filed a response last week, denying any errors or wrongdoing and asking for the case to be dismissed.
A Jan. 23 motions hearing is scheduled in the case.
