Jason Lindemann PC: Fox 11 Online
OSHKOSH, WI (WTAQ-WLUK) – Jason Lindemann’s conviction for causing a 2022 boat crash on the Fox River should stand, the state said in response to Lindemann’s appeal.
Lindeman was sentenced to five months in jail, three years on probation, and ordered to perform 150 hours of community service for the July 9, 2022 crash between his powerboat and the On The Loos paddlewheel cruise boat. He was also ordered to pay $11,702.79 in restitution. The crash injured more than a dozen people.
Lindemann appealed, claiming he drove his boat like “every boater does “ and that the evidence doesn’t support the convictions.
In the 40-page reply filed late Monday, Assistant Attorney General Michael Sanders cited four reasons the convictions should stand:
- The evidence at trial was sufficient to prove Lindemann guilty of recklessly endangering safety
- The circuit court properly exercised its discretion when it denied Lindemann’s motion for a change of venue
- The circuit court did not erroneously exercise its discretion when it allowed Warden Neal to give expert opinion testimony that Lindemann was driving his boat at a speed that was not reasonable and prudent when it crashed into the other boat
- Lindemann is not entitled to a new trial in the interests of justice
Lindemann’s attorney requested oral arguments in the case, but none have been scheduled.
A reply by Lindemann’s attorney is likely the next step in the case.
