APPLETON, WI (WTAQ-WLUK) — A judge rejected Brooke Seal’s request to reduce her nine-year prison term, which was issued in connection with the drug overdose death of Seal’s 2-year-old daughter.
Rosalie Garcia died at a Freedom apartment in January 2024 after being exposed to fentanyl. Seal, 30, was convicted of child neglect-consequence is death for allowing a drug dealer, Faheem Jones, to stay in her apartment. Besides the nine-year prison term, Seal was placed on extended supervision for eight years.
Jones is scheduled to stand trial Jan. 20 on drug charges. He does not face charges in connection with Garcia’s death.
Seal requested the judge reconsider rulings in the case for the sentenced to reduced to five years in prison. Prosecutors opposed the request.
In a seven-page ruling issued Monday, Judge Carrie Schneider denied the motions.
Here, the Court noted that Seal was described as a good employee and mother, but also someone who struggled with addiction. The Court may have emphasized how Seal’s bad choices ultimately resulted in the death of her child, but the Court still considered Seal’s character when imposing sentence. The fact that the Court did not discuss the PSI’s conclusion that Seal’s drug use arose out of an effort to deal with abuse that Seal had suffered as both a child and an adult or recount that history on the record does not mean that the Court failed to consider Seal’s character. The Court imposed a sentence that reflected the seriousness of Seal’s conduct—engaging in illegal drug use and leaving dangerous, illegal substances where her child could tragically consume them and die. The Court finds no basis to revisit Seal’s sentence,” the judge wrote.
