OSHKOSH, WI (WTAQ-WLUK) — A judge Monday denied Erik Metzig’s request to withdraw his no contest pleas for killing his parents.
Metzig, 28, was convicted last year for the March 18, 2023 deaths of David and Jan Metzig. However, before the case could get to sentencing, Metzig’s attorneys filed a motion asking to withdraw the pleas, claiming evidence of his being a sexual assault victim should be considered a new factor that a jury should be able to consider in terms of provocation for the murders. Prosecutors opposed the motion.
Judge Michael Gibbs said the evidence of the sexual assault isn’t “credible,” in his assessment, and denied the motion.
The judge also rejected a defense motion claiming Metzig’s plea wasn’t entered properly and he wasn’t fully aware of the facts allegedly by the state.
After denying the motion, Judge Gibbs set an Oct. 17 sentencing date. He faces life in prison on each count, but the judge could set dates when Metzig could first ask for parole.
Police were called to the home around 5:15 a.m., where the dead couple was discovered. Police found the bodies in the bedroom, covered in blankets, with apparent gunshot wounds to the head, the criminal complaint states.
According to their obituary, David and Jan Metzig were third-generation owners of Union Star Cheese Factory near Fremont.
