OSHKOSH, WI (WTAQ-WLUK) – The suspect in a fatal stabbing Saturday night has not been charged, but is being held without a court appearance due to a probation hold and a judge’s order.
Police requested a charge of first-degree intentional homicide against Daunte Riley, 19, for the incident at Menominee Park. He will not be in court Tuesday. An initial appearance date has not been set.
While suspects normally appear in court within 72 hours of their arrest, there are mechanisms that allow that hearing to be delayed. Two are being used in this case:
- A judge signed what’s known as a “probable cause” order, allowing Riley to be held
- A probation hold by his parole agent allows Riley to be held
Court records show Riley was sentenced in April on criminal damage to property and bail jumping charges in a Fond du Lac case. The sentence included 18 months on probation.
According to a news release, officers were called to a car crash in the 900 block of East Irving Ave., just west of Menominee Park around 11 p.m. There, they found an adult man, the driver of the vehicle, dead with multiple stab wounds.
After further investigation officers discovered there was a fight that took place between multiple people in Menominee Park which resulted in one man being stabbed.
The victim’s name has not been released.
