FOND DU LAC, WI (WTAQ-WLUK) – An Oct. 27 trial date was set for Taylor Schabusiness for allegations she assaulted a staff member at the Taycheedah Correctional Institution.
Schabusiness is serving a life term for the murder and dismemberment of Shad Thyrion in Green Bay.
During her last court appearance, Schabusiness lunged at her attorney, Chris Julka, before being restrained by deputies. Due to that outburst, Schabusiness appeared in court Tuesday with her feet bound and hands cuff. Four officers surrounded her, including one holding her chair at all times.
Her current attorney, Chris Froelich, suggested Judge Anthony Nehls should recuse himself from the case because he witnessed that attack. The judge declined, but said Froelich could submit a formal motion.
Froelich also represented Schabusiness during her murder trial in Green Bay.
Froelich also addressed the attack in terms of Judge Nehls’ status on the case.
“Does the court feel that it maybe needs to recuse itself because of the observations or whatever you witnessed during those proceedings? I would just put it out there. I could maybe file a motion on that; we could take it up at the appropriate time. But I just kind of wanted to put that out there because, obviously, something happened and the court was witness to that,” Froelich said.
“I don’t feel that way. The incident happened. I don’t think one or another about it, quite frankly. So, if you’re asking me to recuse myself — if you want to file a motion, you certainly can — but if you’re asking me if I somehow feel any way, one way or another, towards Miss Schabusiness, I don’t because of that incident, doesn’t change,” the Judge said.
Froeloich said he would discuss the issue further with Schabusiness.
Judge Nehls warned Schabusiness that any future outbursts could threaten her ability to attend future hearings, including the trial.
The April 4 attack on Julka was the second time Schabusiness has attacked her attorney. She attacked Quinn Jolly during a hearing before her trial in the murder case.
According to the criminal complaint, Schabusiness, 27, needed care from a nurse after falling on a staple, which lodged in her arm. The sergeant — who is labelled “VICTIM” in the complaint — escorted her to the medical room on July 24. That’s when Schabusiness allegedly attacked her.
