MERRILL, WI (WTAQ-WLUK) – One of the teens charged in connection with the death of a counselor at the state youth prison will remain in adult court, a judge ruled.
Javarius Hurd, 16, is charged with first-degree reckless homicide and two counts of battery prisoners for the June 24 incident at Lincoln Hills-Copper Lake Schools, which resulted in the death of Corey Proulx.
In Wisconsin, those ages 10-16 facing most homicide counts are charged in adult court. The defense, as it did in this case, can seek what’s known as a “reverse waiver” to have the case moved to juvenile court.
After a three-day hearing, however, Lincoln County Judge Galen Bayne-Allison denied the motion, keeping Hurd in adult court, court records show.
Hurd returns to court March 7. No trial date has been set.
Also charged in the case is Rian Nyblom, 18, is charged with felony murder-battery, and battery by a prisoner for his alleged role. He has pleaded not guilty, but no trial date has been set. He returns to court March 25.
