GREEN BAY, WI (WTAQ-WLUK) – Antwon Powell will not get a new sentencing hearing on his parole eligibility date for the 2015 murder of David Shorter.
Powell, 37, is serving a life prison term after being convicted of first-degree intentional homicide for the murder at a duplex on Bellevue Street on Dec. 3, 2015. At sentencing, Judge John Zakowski said Powell would be eligible to ask for parole after 38 years.
Powell’s attorney, John Wasielewski, argued Monday that the judge’s reliance on Shorter’s life expectancy for setting that 38-year date was improper.
Deputy District Attorney Wendy Lemkuil contended the motion should be denied, and that the judge was within his authority.
Judge Zakowski reviewed his comments from the sentencing hearing, noting the variety of factors he used in setting the date. But since the life expectancy was not the only factor considered, he denied the motion.
According to the criminal complaint, Powell had accused Shorter of breaking into his home and stealing money and marijuana earlier that day. The two had argued back and forth on the phone throughout the day. That night, Powell went to Shorter’s home on Bellevue Street and shot him when he went outside for a cigarette, the criminal complaint states.
