OSHKOSH, WI (WTAQ-WLUK) – The owner of the Oshkosh Arena admits it’s behind in property tax payments but denies the company is insolvent and unable to pay its bills.
Bayland Buildings constructed the arena, 1212 S. Main Street. Bayland filed suit in June, alleging it’s owed more than $12 million.
Within the last week, Oshkosh Arena and Fox Valley Pro Basketball filed its reply to the lawsuit. Among its responses:
- “FVPB last made a payment to Bayland in March of 2024” but denied being ‘consistently delinquent’ with payments as alleged
- FVPB admits it “had not yet paid the 2023 real estate tax obligations as of the date of the complaint.”
- As to the claim it owes $12,417,464.82, FVPB says it lacks “knowledge and information sufficient to form a belief as to the truth of the allegation and therefore deny and put Plaintiff to its burden of proof.”
- As to the claim FVPB, “FVPB is insolvent or in imminent danger of insolvency,” it simply replied “Deny.”
- As to the claim FVPB, “has failed to make payments to Bayland and is in material breach of its contractual obligations,” it replied “Seeks a conclusion of law to which no response is required; Defendants put Plaintiff to its burden of proof.”
No hearings have been scheduled in the case.
Oshkosh records show three missed property tax payments this year on Jan. 31, March 31, and May 31, totaling $482.586.95. Another payment is due July 31.
The main tenant of the arena, the Wisconsin Herd basketball team, has already announced several of its home dates for the upcoming season.
