GREEN BAY, WI (WTAQ-WLUK) – The Green Bay Board of Education has called a special meeting for Thursday night to discuss strategy for potential litigation and a personnel matter pertaining to superintendent Dr. Claude Tiller.
The meeting comes as we learn the public will have to wait until next week to hear what superintendent Tiller said, on an Atlanta radio station last week. The comments leading to an investigation, into Tiller, by the Board of Education.
The board announcing late Tuesday the superintendent was put on paid administrative leave while an investigation into the issues related to the radio appearance are sorted out.
It’s been more than a week since Green Bay Area Public Schools superintendent, Dr. Claude Tiller, appeared on an Atlanta radio program. Comments he reportedly made while on “REALationship Talk with Dr. Adrienne” led the Green Bay board of education to put the superintendent on leave.
Originally posted online, the recording of the show appeared to be scrubbed from the internet over the weekend.
The Green Bay Area School District has a copy of the radio show, and is reviewing Tiller’s comments, as part of its investigation into his actions.
“If the public wants to obtain a copy of whatever they have in their possession, the proper way to do that would be through a formal open records request,” said attorney Kurt Goehre, an attorney with Conway, Olejniczak & Jerry in Green Bay.
On Monday, FOX11 submitted an open records request to officials with Green Bay Area Public Schools, for a copy of the recording. More than a day later we learned the request would be granted, but it would take several days to fulfil as part of the district’s legal obligation to the people or subjects impacted by the release of the recording.
According to Goehre, “They (the district) have to provide a notice to the individual that’s subject to the record to allow them to access the record and determine whether there’s any interest they have that they may want to contest before they release the record.”
In this case, the district’s legal counsel informing FOX 11 –
As local public office holders, both individuals, the Superintendent and a Building Principal, are entitled to advanced notice prior to release…
The district’s attorney writing,
…the District must provide five (5) days notice, excluding weekends, for them to supplement the records with written comments and documentation.
“It’s a waiting period to allow an individual to protect their rights, whether it’s reputational, privacy rights or some other right to take further action which could include contesting the release through a court order,” added Goehre.
Reasons to contest the release of the record, need to be significant.
In this case, Dr. Tiller and the unnamed building principal would need to prove their reputation or privacy would be significantly impacted by the release of the recording. Those arguments, if they have them, need to submitted to the district’s counsel within five days, excluding weekends.
The clock started Tuesday.
Barring any objections, the Green Bay Area Public School district plans to release a full copy of the recording a week from today.
