GREEN BAY, WI (WTAQ-WLUK) — More than a dozen motions are scheduled to be argued this week in the case against murder suspect Taylor Schabusiness.
Schabusiness, 25, is charged with first-degree intentional homicide, mutilating a corpse and third-degree sexual assault for allegedly attacking Shad Thyrion last year. She has pleaded not guilty and not guilty by reason of mental disease or defect. She is scheduled to stand trial July 21.
Before trial, however, the attorneys and Judge Thomas Walsh have multiple issues to sort through, mostly dealing with what evidence will be allowed at trial. A hearing is scheduled for all day Tuesday to discuss them.
In a letter to the attorneys, Judge Walsh outlined the issues, and the order he plans to address them.
Among them:
- A defense motion for another competency evaluation
- A defense motion to prevent use of her statements to police
- A defense motion to prevent use of evidence seized from her apartment and a vehicle
- A defense motion to dismiss the sexual assault count
- A defense motion to dismiss the entire case, based on a defective criminal complaint
- A prosecution motion to exclude certain expert witness testimony
Jury selection is scheduled for July 21, with opening statements and testimony beginning on July 24.
According to the criminal complaint, police were called to a residence on Stony Brook Lane early in the morning of Feb. 23, 2022. There, police found a severed head inside a bucket in the basement.
Schabusiness said she and the victim were using drugs, including meth, and engaging in sexual play, when the man was strangled. She then sexually abused him, dismembered the body and placed body parts in various locations in the home and a vehicle, the criminal complaint states.
