KANSAS CITY, MO (WTAQ-WLUK) – Garland Nelson is now expected to plead guilty to killing two Shawano County brothers, federal court documents state.
Nelson allegedly killed Nick and Justin Diemel in 2019, related to business deals for the sale of cattle.
Beside the homicide charges in state court, Diemel is charged with fraud in federal court. That trial is scheduled to start Monday, but in court filing Tuesday, federal prosecutors updated the court.
“Nelson is anticipated to enter a guilty plea to those counts within the next two days. Should that guilty plea not occur, the United States would request this Court re-issue the Writ of Habeas Corpus Ad Prosequendum in advance of trial scheduled before this Court on October 3, 2022,” prosecutors wrote.
A judge signed the order, which would allow Nelson to be transferred from federal custody to state custody.
Online court records for Missouri state courts indicate a motion hearing is scheduled for Monday. It’s unclear if another hearing will be scheduled to reflect the expected change in plea mentioned in federal court.
Nelson allegedly killed Nick and Justin Diemel, who went to Nelson’s farm in northwestern Missouri related to the cattle business. Court documents allege Nelson fatally shot the brothers who came to collect a $250,000 check.
