GREEN BAY, WI (WTAQ-WLUK) – A first-offense drunk driving ticket filed in connection with a double-fatal crash was dismissed Thursday, with prosecutors saying criminal charges could still be filed in the case.
Marcus Walker allegedly ran a stop sign Oct. 23 in New Denmark, killing Jamie Lee Cain, 42, and Katherine Mae Rathie-Dunn, 41.
The Brown County Sheriff’s Department issued Walker a citation for first offense operating while intoxicated, and requested criminal charges in the case. Walker’s attorney, Brittany Van Rite, noted at the first court hearing that a preliminary breath test showed a BAC of just .036, well below the legal limit of. 08.
To date, no criminal charges have been filed. In advance of Thursday’s hearing, Brown County District Attorney David Lasee asked for the ticket to be dismissed – at least for now.
“Investigation into this incident is ongoing and likely will be for some time. Based on the results of that investigation, the State may be issuing criminal charges out of this incident,” the letter stated.
At Thursday’s hearing, Judge Tammy Jo Hock granted the state’s request to dismiss the citation.
At a previous court hearing, Domina Stamas, Rathie-Dunn’s sister, told the court she was pleased with the decision then not to file charges for the “tragic accident,” noting charges would not bring back her sister and her fiancé.
