ASHWAUBENON, WI (WTAQ) – No criminal charges will be brought against three Green Bay police officers who opened fire on the man who opened fire at the Radisson Hotel/Oneida Casino complex back in May.
Investigators say three Green Bay officers shot and killed 62-year-old Bruce Pofahl near the first-floor parking ramp on the complex’s east side after Pofahl walked into the Duck Creek Restaurant and Bar and fatally shot Jacob T. Bartel and Ian J. Simpson. They say Pofahl also hot Daniel Mulligan, who survived.
Brown County District Attorney David Lasee wrote in part:
Based upon my review of the materials provided by the State of Wisconsin Department of Justice-Division of Criminal Investigation (DCI), I find no evidence to suggest criminal conduct on the part of any Green Bay Police officers, as the facts and circumstances of the incident created a situation where the involved officers were privileged to utilize deadly force against Mr. Pofahl. Therefore, there is no basis to issue criminal charges against the officers related to Mr. Pofahl’s death.
The decision also reads:
When Pofahl once again raised that weapon, all three officers were aware that he posed an imminent risk of death or great bodily harm to themselves and to other individuals, they made the decision to utilize deadly force in protection of others, and as a reasonable fulfillment of their lawful authority.
