DE PERE, WI (WTAQ) — A former Vice President of St. Norbert College has won a defamation suit he filed against a Green Bay man.
The Rev. Dr. Jay Fostner filed the suit against Jason Jerry for posts Jerry made on social media and other digital platforms.
On Wednesday, the judge decided in Fostner’s favor. The two parties then agreed to a settlement, which awards the priest only one dollar in damages, provided Jerry follows the terms of the agreement.
As part of the suit, Jerry will remove all “defamatory statements” against Fostner “from publicly accessible platforms, including but not limited to Facebook, YouTube, and any media comment section, that are under his control. The defamatory statements which must be removed include, but are not limited to, statements identified in the Complaint in this matter and substantially similar statements about (Fostner). Affected statements include both direct references to (Fostner) by name and indirect references which attempt to identify (Fostner) by occupation, positions held, or any other information which can reasonably be construed to identify (Fostner).” Jerry “shall complete the required removal within 21 days”.
Additionally, Jerry “shall forever refrain from repeating and/or publishing the statements referenced” or “making similar statements to any party in the future,” the ruling states.
If Jerry would violate those terms, or file an appeal of the ruling, punitive damages of $100,000 would be awarded to Fostner.
Fostner and St. Norbert College parted ways in January of 2020. Fostner was the central figure in student, alumni, and staff criticism of the school’s handling of sexual assault reports.
