WINNEBAGO COUNTY, WI (WTAQ-WLUK) – No criminal charges will be filed against SWAT team members involved in the fatal shooting of a man in Fox Crossing.
On Jan. 21, officers were called to a home in the 800 block of Grove St. to arrest a man allegedly connected to multiple crimes in the area.
According to officers, 32-year-old Rory Behling was inside the home with a gun.
Behling was killed in the shooting. No law enforcement officer was hurt.
According to the report released Friday, Behling was armed and refused to follow SWAT team members’ commands. The report also said Behling pointed his firearm at officers and discharged his weapon. The report says, “Behling’s actions clearly demonstrated his intent here. his intent was to evade arrest at all costs, even if it meant taking the life of officers who were on scene. This conclusion is supported by the fact that Behling had made statements that we has not going back to prison.”
Winnebago County District Attorney Christian Gossett determined the SWAT team members’ use of deadly force was justified.
